În anul 2006,
profesorul de yoga, scriitorul şi dizidentul politic
Gregorian Bivolaru a primit azil politic în Suedia. Acest film este o investigaţie
asupra cazului său şi se bazează pe declaraţia dată de el judecătoarei Adriana Ilieş
de la Tribunalul din Cluj, România, în anul 2014. – Careful with the door…

simultaneously entered many houses used by MISA followers. Last night, 300 policemen,
gendarmes and prosecutors searched Ferentari to dismantle lairs
of prostitution, pornography and human trafficking. They clearly focused on houses
in which the investigators knew that members of Gregorian

codename “Operation CHRIST”, as the authorities call it,
began a week ago. The investigators wish to use this
operation as a means to lift the veil from a series of activities of one of

în asemenea momente, ci doar vezi un bărbat în negru

Nobody move ! Am crezut că vor să ne omoare. Nu ştiam ce s-a petrecut, am crezut pur şi simplu
că au venit să ne omoare. România este o ţară fascinantă care a devenit recent
membră a Uniunii Europene. Însă umbra dictaturii comuniste
încă mai marchează ţara, iar tranziţia de la dictatură către
o democraţie modernă şi funcţională este un proces în desfăşurare
care întâmpină multe obstacole. Problemele inerente unei asemenea
tranziţii au devenit tot mai clare atunci când corupţia a ajuns
la cele mai înalte nivele, iar drepturile omului şi chiar şi
legislaţia de bază au fost încălcate. Organizaţiile pentru
apărarea drepturilor omului s-au ocupat de multe
cazuri în România, unde dreptul la libertate individuală,
la un proces corect şi la integritatea fizică
şi psihologică sunt violate, ceea ce pentru o persoană
născută şi crescută într-o democraţie sănătoasă
poate fi greu de înţeles. Cel mai controversat caz din
istoria modernă a României care reflectă aceasta este cazul profesorului de yoga
Gregorian Bivolaru şi al şcolii de yoga MISA
pe care el a fondat-o, după cum veţi vedea în acest film. “Why was Năstase condemned ?” “Comunismul:

au fost puternic politizate, şi ca atare
atât structura magistraturii, cât şi poliţia, presa şi armata au fost aproape complet
subjugate voinţei dictatorului şi a colaboratorilor săi apropiaţi. Aceştia erau politicieni de rang înalt
din Partidul Comunist şi totodată mulţi erau lideri ai celui mai puternic
instrument de opresiune, temuta poliţie secretă,
numită Securitate. Please, move on ! Fiind singura ţară din lume
care a făcut acest lucru, guvernul român a interzis în 1982
practicarea de yoga, karate şi alte activităţi similare, şi totodată a închis şi
Facultatea de Psihologie. Asemenea studii şi practici
erau considerate atunci un pericol pentru siguranţa naţională. Articolul 18 din Declaraţia Universală
a Drepturilor Omului asigură tuturor dreptul la libertatea
de gândire, conştiinţă şi religie. Un drept pe care România
a ales să îl ignore în 1982. Revoluţia din 1989
a abolit dictatura, iar astăzi România este în mod oficial
o democraţie modernă şi liberă. Dar câteva cazuri indică faptul că,
deşi constituţia a fost schimbată, adevăratul centru de putere, mai precis
administraţia din vremurile comuniste, a rămas la putere
sub vălul subţire al democraţiei. In all structures of power,

and cultural movements which were the focus of attention
of the Securitate before 1989. Şcoala MISA este
o asemenea organizaţie. În 1995,
statul român a autorizat măsuri secrete
de supraveghere a MISA, inclusiv interceptarea telefoanelor, infiltrarea agenţilor în cadrul şcolii
şi alte câteva strategii sub pretextul că şcoala reprezintă
o ameninţare la siguranţa naţională. Unii profesori au ţinut
conferinţe publice în care au pus sub semnul întrebării colaborarea României cu NATO şi viitoarea aderare
la Uniunea Europeană. În alte democraţii, asemenea opinii ar fi fost o parte
firească a unui proces democratic şi a unui schimb de opinii. Însă în România au fost clasificate
drept un gest antipatriotic care necesită o supraveghere strictă, cel puţin atunci când autorii
erau practicanţii yoga de la MISA. Vreau să vă spun că în România
acest sistem nu este controversat, pentru că mulţi oameni
vin la această şcoală. Acţiunea guvernului
şi a liderilor politici care ordonă multe înscenări şi multe campanii de presă
şi de televiziune le susţin. Dar, în realitate, oamenii sunt
foarte bucuroşi să practice yoga. Şi trebuie să remarcaţi că, în pofida presiunii enorme
exercitate de presă, de televiziune şi de poliţie, mulţi oameni aleg
să vină la această şcoală. Există 37.000 de oameni
la această şcoală, cea mai mare şcoală de yoga
din Europa. Iar acesta nu este o întâmplare,
ci este o necesitate. De asemenea, avem multe
filiale şi în alte ţări. Această şcoală de yoga
are filiale în 20 de ţări. Sunt mulţi oameni care practică
această formă de yoga. În epoca lui Ceauşescu,
practicanţii yoga şi alte minorităţi spirituale
au fost arestaţi, torturaţi, discreditaţi din punct de vedere
moral, unii au fost chiar ucişi, acuzaţiile împotriva lor fiind
infracţiuni de drept comun. Dar acesta a fost,
de fapt, un paravan pentru exercitarea
opresiunii politice împotriva lor. The files from the Securitate obviously could not contain recordings and leave behind video footage
and written material on the torture and beating of people. These actions were illegal also
back then, at least in principle. Obviously, some things which were
also illegal eluded them. For instance, Securitate files
refer to the need to invent some criminal cases
regarding common-law offences. It was not convenient for
the Securitate to treat their cases as cases which
opposed the regime, so they looked for other reasons. It is clear how the Securitate gave
the Prosecutor’s Office such a mission. Cazul lui Gregorian Bivolaru
şi al şcolii MISA dezvăluie modul cum acele
rădăcini şi strategii ale unei puteri opresive şi abuzive din vremurile dictaturii comuniste
încă mai marchează ţara. Acest film dezvăluie metodele pe care
ei încă le mai folosesc şi astăzi atunci când întâlnesc opoziţie,
înscenând dosare penale, la fel cum au făcut şi
în timpul dictaturii comuniste. Bucureşti,
18 martie 2004 În 2004, Gregorian Bivolaru şi
şcoala MISA fondată de el au fost ţinta celei mai de amploare

şi ameninţaţi. Mulţi dintre ei pretind că autorităţile au încercat să îi forţeze să semneze
documente false şi incriminatorii împotriva mentorului spiritual
al şcolii, Gregorian Bivolaru. They actually came to me with
a written draft asking for my help and they wanted me to make
a statement which would incriminate Mr Gregorian Bivolaru and
lock him up for many years to come. One prosecutor told me very clearly
that, no matter what I did, they want to see Bivolaru in chains. Drug trafficking, prostitution,
organised crime, video-chats… We continue our activities… Intelligence officers
have announced to the prosecutors that many buildings in the capital house activities
related to prostitution, drug trafficking and tax evasion. For this reason,
investigators commanded the biggest display
of police force since 1989. 15 simultaneous raids on buildings
indicated by the police. Tear gas canisters, ampoules with unknown substances, thousands of photos
of MISA followers barely dressed or naked. Radio stations, data bases, surveillance equipment and
tons of propaganda material were discovered today
in a building in Ferentari by the prosecutors of
Bucharest’s Court of Appeal. Even though none of the followers
of Bivolaru’s movement have yet to be charged,
investigators say that the movement’s organisation
is paramilitary in nature. Poliţia a intrat la noi în casă ca nişte terorişti, cu arme automate, fără să ne arate vreo legitimaţie
sau act de identificare, deşi noi am cerut să le vedem. Nici acum nu ştiu care a fost motivul pentru care au făcut-o. Am văzut la televizor
că ne acuză de prostituţie, de droguri, de tot felul de lucruri pe care nu le-am experimentat
în viaţa mea. Mi-am întrebat colegii ce se petrece. Ei au spus că intruşii făceau parte
din Serviciul Român de Informaţii. Nu am înţeles ce căutau forţele de
securitate române într-un ashram yoga. Deoarece, dacă există un loc al păcii
pe această planetă, acela e un ashram yoga. Dacă există un loc
unde poţi fi sigur că nu se desfăşoară activităţi ilegale,
acela este un ashram yoga… Gregorian Bivolaru a fost acuzat
de mai multe ilegalităţi extreme şi, cum el a considerat
că viaţa lui este în pericol şi că întregul caz e o înscenare aranjată de fostul prim-ministru
Adrian Năstase, a fugit în Suedia anul următor,
în 2005. Acolo, pe 16 martie, a înaintat
o cerere de azil politic autorităţilor de imigrare din Malmo. Şi-a motivat cererea prin persecuţia
la care a fost supus în România. Curtea Suedeză a demarat
o investigaţie oficială amplă. Au intervievat
un grup mare de martori şi au colaborat cu
diverşi experţi în sectarism pentru a evalua dacă şcoala
este una autentică, sau dacă este o acoperire
pentru o sectă criminală ilegală, cum susţineau autorităţile române. Ei nu folosesc oamenii
pentru interese personale. Oamenii frecventează şcoala
din proprie voinţă şi este modul lor de a încerca
să se împlinească şi să îşi găsească pacea
şi armonia interioară. Experţii au concluzionat
că Gregorian Bivolaru era nevinovat şi că şcoala
nu este o sectă. Curtea Suedeză i-a oferit azil politic,
în parte deoarece au considerat că el nu ar avea parte
de un proces corect în România, şi în parte pentru că au considerat că
el ar fi în pericol în propria sa ţară. Puteţi observa că justiţia suedeză a descoperit că totul a fost
o înscenare a românilor şi m-a eliberat. Iar acest aspect e semnificativ
pentru justiţia din România. Mulţumesc foarte mult ! This is a slap in the face
for the Romanian justice system and we wish to uncover the truth. It is very important that we make
a quick, fair and real investigation regarding what happened
when he was arrested. When Gregorian Bivolaru was given
political assylum in Sweden because the fundamental individual
freedoms are not respected in Romania, it was the most obvious proof that the Romanian justice
system does not work. Între timp, în România,
în anul 2010, Curtea din Sibiu a hotărât că
Gregorian Bivolaru este nevinovat, şi asta după 7 ani
de proceduri judiciare. Un an mai târziu,
Curtea de Apel din Alba-Iulia a ajuns la aceeaşi concluzie. Procurorii au făcut recurs
şi la această decizie, motivând că vroiau
ca Gregorian Bivolaru să aibă şansa să îşi prezinte liber
declaraţia de martor în cel de-al treilea proces, deoarece până acum el a vorbit
doar prin avocaţii săi. Această motivaţie a fost
foarte controversată, deoarece Gregorian Bivolaru
nu avea niciun interes ca acest caz să fie rejudecat,
întrucât el îl câştigase deja. În 2013,
când era pe cale să fie audiat la Înalta Curte de Casaţie
şi Justiţie din Bucureşti, într-o conferinţă video
aranjată de autorităţile suedeze, judecătorii români i-au refuzat
acest drept în ultimul moment. Curând după aceea,
judecătorii l-au condamnat la şase ani de închisoare. Acest verdict a fost atacat la
Curtea Europeană a Drepturilor Omului, unde aşteaptă să fie soluţionat. România e cunoscută drept una dintre
cele mai corupte ţări din Europa, unde sistemul judiciar
este supus presiunii politice şi presiunii altor grupuri de interese, cum ar fi mafia larg răspândită şi chiar anumite cercuri ale puterii cu
reminiscenţe de pe vremea comunistă în interiorul
Serviciului Român de Informaţii, versiunea modernă a Securităţii. UE era conştientă
de această corupţie când a acceptat ţara ca stat membru şi a pus clauza ca
această calitate de membru să fie condiţionată de
o monitorizare activă a progresului din ţară. Ca atare, cazul MISA

care încă mai persistă. Modul în care aceşti oameni
au fost arestaţi şi interogaţi, iar casele lor percheziţionate, nu are ce căuta
într-un stat democratic european. Veţi ridica problema MISA
aici, la Bruxelles ? Sunteţi pregătită
să acţionaţi în acest sens ? Dacă oamenii nu vor primi
scuze şi despăgubiri pentru defăimarea
la care au fost supuşi, mai ales în cazul celor
al căror nume a fost complet distrus, cred că trebuie să fie
despăgubiţi într-un fel, dacă situaţia nu se va modifica,
evident voi acţiona mai departe ! Cazul a ajuns la funcţionari de
rang înalt din Parlamentul European, deoarece practicanţii yoga s-au plâns
de tratamentul la care au fost supuşi şi de persecuţiile împotriva
lui Gregorian Bivolaru. Aici, peste 50 de membri
ai Parlamentului European au atras atenţia guvernului român asupra hărţuirii şi
procedurilor ilegale folosite de poliţie
şi procurori. Întâmpinăm din nou şi din nou
această problemă de încălcare făţişă
a drepturilor omului în statele membre şi în special
în câteva din noile state membre. Există un refugiat,
un yoghin din România, care este persecutat încă
de pe vremea lui Ceauşescu. În 2007, el a primit
azil politic în Suedia. Şi aici trebuie să recunoaştem că există probleme, ca cea expusă
de prietenul nostru suedez, problema lipsei de respect faţă
de lege, în unele state membre. Aceasta este, de asemenea,
o cerere pentru fiecare stat membru să respecte drepturile omului, după cum au fost ele enunţate
de Convenţia de la Strasbourg. La fel ca toate statele membre
ale Uniunii Europene, şi guvernul român este obligat
să le respecte, la rândul lui. Încă aştept dovada. Am scris acum
Comisiei Europene din Bruxelles şi i-am cerut
să urmărească acest caz judiciar deoarece nu cred că domnul Bivolaru
va fi judecat corect. În aceeaşi perioadă în care a fost judecat procesul individual
împotriva lui Gregorian Bivolaru, Parchetul a demarat
în paralel încă un proces în care l-au acuzat pe el şi
pe încă 21 de cursanţi yoga de crimă organizată. Mai precis,
de trafic de persoane. În ochii procurorilor, munca voluntară
făcută de cursanţi pentru şcoală era considerată
trafic de persoane. Acest film vă aduce
mărturia lui Gregorian Bivolaru aşa cum a fost ea prezentată
judecătoarei Ariana Ilieş la Curtea de Apel din Cluj
în februarie 2015, în cadrul primului proces cu privire la munca voluntară
realizată de cursanţii MISA, în care e acuzat de trafic de persoane. Your Honour,
my name is Gregorian Bivolaru, I was born on March 13, 1952, in Tărtăşeşti, Ilfov county, and my parents were
Constantin and Floarea. I currently live in Karlskrona, Sweden, where I received political asylum following a court order issued by
the Supreme Court of Sweden. They have found that if
I am extradited to Romania I might be subjected
to severe persecution by the Romanian authorities,
because of my beliefs. This current audio-video footage
was recorded on February 1, 2015, at the legal address at which
I currently live in Sweden. I am giving this statement
as a defendant in file number 22351,
dated March 2007, of the Cluj Court. I will begin by stating that the great sages of
this planet have said that “No justice is higher than truth !” That is why I beg you
in the name of truth and justice to listen carefully and patiently
to what I have to say and to properly analyse
my statements, which are based
on conclusive evidence, and without exception
on clear, ireffutable proof. What I am saying to you
is also a poignant plea for the immediate triumph
of truth and justice. Considering that
hope is the last to die, I am still hoping that
you will do justice in this case which I personally consider to be a disgrace to
the Romanian justice system. And I am stating that
this file was fabricated in haste, following the political order of the former prime minister,
Adrian Năstase. As you may already know, because of the abuse and illegalities
that he carried out, this man was twice sentenced
to imprisonment. 4 years in prison
for Adrian Năstase, and a 3 year suspended
sentence for Dana Năstase. A tough punishment
for the Năstase couple for charges of receiving bribes. The decision of the judges is final and Adrian Năstase
has already surrendered himself. Not long ago, he gave some statements. – Did you expect this verdict ?
– Obviously I did not. It is very good that
the justice system works and is going
in the right direction without fear of politicians. Let us remember
how it was before 2004, when no politicians were
sent to court. This is why I am saying
that these judges should be congratulated and defended, and also the prosecutors
and the police who are doing their duty fairly,
professionally, and without being afraid
of the political class. As you already know, I created NAD
(National Anti-corruption Directorate). The results are palpable. Voiculescu Dan:
10 years in prison, 60 million euros to be reimbursed
to the Romanian people. Adrian Năstase:
4 years in prison, 1.5 million euros to be reimbursed
to the Romanian people… Consequently, my statement
is not meant to amaze you. It is said that justice is blind. But it should not be deaf, as well, to the clear and obvious truths which a human being
who is wrongfully accused exposes into the open
for the triumph of truth and to shatter lies. The interventions of
the so-called hatchet men which the former prime-minister
Adrain Năstase disposed of are almost obvious in this case. For example, the PSD stenographs
which were disclosed at the time are and remain living proof,
especially by mentioning my name, and all of these things that constitute a significant body of evidence
weighing heavily on the side of justice. This shows once again that this file
was fabricated in haste following political command. This is why I believe that this file is a great disgrace
to the Romanian justice system. At the time, when they
carefully analysed this file, the judges from
the Supreme Court of Sweden were absolutely stunned by the aberrations and
the contradictions presented in this file. Unul din argumentele principale
ale Curţii suedeze pentru care i s-a acordat
azil politic lui Gregorian Bivolaru nu a fost propria sa
declaraţie scrisă, ci chiar argumentul pe care
procurorii români l-au folosit pentru a convinge Curtea suedeză că Gregorian Bivolaru
este o persoană periculoasă. Românii au folosit articole din presă
pe post de dovezi incriminatorii, articole care erau foarte ostile
şi jignitoare ca limbaj şi conţinut faţă de Gregorian Bivolaru. Politicienii din Parlament
au fost citaţi pentru folosirea unui limbaj
foarte vulgar împotriva lui iar procurorii au invocat
necesitatea arestării lui pentru că altfel ar fi în pericol de a fi bătut sau linşat
de părinţi supăraţi. Nivelul argumentelor
procurorilor români a fost atât de neprofesional, încât propriile lor materiale
au devenit un factor major care a convins Curtea suedeză că Gregorian Bivolaru a avut dreptate
când a pretins că a fost persecutat şi că nu ar avea parte de
un proces corect în România. Acest nivel scăzut de profesionalism
putea avea doar două cauze: fie un grad foarte scăzut
de educaţie competentă în rândul procurorilor din România, fie intenţii negative conştiente,
cum ar fi corupţia. We are now witnessing
some very surprising decisions, which lead to many doubts regarding the fairness
of judges… Taking into account
the multitude of abuses and gross injustices
which abound in this file, I still dare to hope
that these words will not be the voice of one
shouting in the desert about the many gross abuses
and illegalities of which I was and still am a victim. Following this necessary introduction, I will go on saying that
I consider myself innocent of all the accusations, many of which are mesmerising,
from my perspective, in this precarious file
which has been fabricated against me by political command. I have never created
a organised criminal group, I have never intended
to form such a group and I have never performed
so-called human trafficking. In addition, I wish to state,
loud and clear, that I have never made
anti-semitic propaganda. Indeed,
the very fact that many Jewish people attend
the yoga classes, some of which come from Israel, to practise yoga in Romania, and are received into this
spiritual community as friends, and who have decided to remain among
the yoga practitioners here even now, all these facts expose the absurd and revolting lies of this accusation. Am fost foarte surprins,

şcolii MISA de cinci ani, dintre care ultimii patru ani
i-am petrecut aici, în Romania. Am locuit într-o comunitate
în Bucureşti numită ashram. Niciodată nu am observat
vreo tendinţă antisemitică aici. Întotdeauna am fost tratat
cu foarte multă căldură de yoghinii români. At the risk of repeating myself, I hereby state that
for me it is obvious that the criminal files which were issued against me in Romania were fabricated at political command by the former prime minister,
Adrian Năstase. Even though this statement
seems incredible, please take into account
the non-accidental fact that Mr Adrian Năstase
at some point publicly admitted his involvment in these files in a television interview with the political analyst
Ion Cristoiu. In this interview,
Adrian Năstase admitted with astounding honesty the serious mistakes that
he has made in this case. This is noteworthy and
you should take it into consideration. I remind you that
you lost the elections because, among other things, the same Police, led by
your Minister of Internal Affairs, and the same prosecutors
ordered a brutal raid on MISA using special forces, live on TV. I remind you,
perhaps I am wrong… – No, you are correct.
– And you took the blame for it. Regarding MISA and
the special forces, you are perfectly right. I believe those events
were a great mistake and I believe it was
very stupid and poorly organised. It was indeed something that
should not have happened. Taking all these aspects
into consideration, and I believe them
to be very serious, please note that the evidence which was presented
by my attorneys in this case is quite significant, and it is also very convincing in establishing my innocence. For this reason, please analyse the evidence
very lucidly and properly, and notice that all of it
points to the fact that none of the accusations
against me are real, proving, most of the time, that this case was fabricated
on political command. I dare say, loud and clear, that the abusive
and illegal manner in which this case was constituted
by the prosecutors unfortunately reminds us of the cases
of sad memory from the Stalinist era. At the same time,
the abusive and illegal manner proves that there is
a strange continuity and a sometimes striking resemblance between the abuses
carried out against me, both before 1989,
during the communist terror, as well as after 1989, especially regarding
the insidious manner in which the Romanian authorities acted in order to suppress me unjustly. The communist regime was eliminated, but not the administration. After December 1989, the communist administration
remained in power. A significant and also
disturbing example of this is that the same prosecutor
who investigated me in 1984, prosecutor Chaborski, also investigated me in 2004, when I was arrested. There was a prosecutor
who was actively involved before and after 1989,
both times against Grieg. He was an active,
operational part of Bivolaru’s case
before the 1989 Revolution. His name is Chaborski,
and he is now retired. There is an old history
with MISA and Bivolaru. Actually,
the basis of this was an action initiated by
Ceauşescu’s Secret Police against the yoga movement. This continued with
the active surveillance of members of the Yoga movement, and later on with
the surveillance of MISA members, and more than 100 people, from what I know, were subjected to this surveillance. This a practice used by the Securitate, to monitor a group of people who supported
freedom of thought and spiritual freedom, and they did it in a cultural way, as was the case with
Transcendental Meditation, and the yoga movement, in general, aspects which were later
included in MISA practices. And afterwards they fabricated
criminal files for all these people related to common law offences. This was a practice used by Securitate in collusion with
the judicial authorities, especially with
the Prosecutors’ Office. Through yoga we would become stronger
than the oppressive regime. Even though physically
it could not really be done, as you were not able to do a thing
without getting arrested. Nevertheless there was
a moral and spiritual force which was much stronger than
the oppressive force of the regime. In order to underline this bizarre continuity, I wish to report briefly what happened to me during the memorably sad dictatorship
of the despot Nicolae Ceauşescu. In many situations during
that time, I was the helpless victim
both of savage repression, as well as of dreadful abuse and of the terror
carried out against me by the sinister Secret Police
(Securitate). I want to point out
that, during the ’80s, when all forms of yoga practice were strictly forbidden in Romania, I still dared to face
the communist terror and I continued to practise
yoga in secret, illegally. After that, my courage
was severely punished and I was imprisoned many times, and during the preposterous
investigations against me I was savagely beaten and tortured, sometimes for days in a row. They beat him so savagely
that they broke his teeth. And this is why he had to
gradually replace most of his teeth after the 1989 Revolution. Gregorian Bivolaru s-a născut
în luna martie 1952, în satul Tărtăşeşti,
judeţul Ilfov. Încă din copilărie,
îi plăcea să citească. Anii de şcoală, de liceu
şi cei care i-au urmat şi i-a petrecut în
bibliotecile din capitală citind mii de cărţi de fizică,
de chimie, alchimie, parapsihologie, hipnoză,
psihanaliză, medicină, sexologie. Gradat, a descoperit tărâmul fascinant
al spiritualităţii orientale şi a devenit dedicat
studiului şi practicii yoga. I translated
books myself, and at that time
there was no copy machine, I translated
from English and French. Of course, I was looking avidly
for fundamental spiritual works which were very hard to find
at the time. They could be found only in the secret department
of some libraries and it required
tremendous effort to get hold of them
and read them and I even copied
many of them by hand. I took a great deal of notes and I regret to say that unfortunately
nothing is left of them after the numerous searches
I was subjected to. Erudiţia şi realizările spirituale

titlul de profesor al Universităţii Internaţionale
Himalayene Vishwaguru Yoga, iar apoi a devenit
profesor autorizat de yoga în cadrul şcolii superioare
de cercetare a Academiei Păcii Universale. În 1971, a început să predea
primele cursuri de yoga. Tot în această perioadă, a început să fie monitorizat
de Securitatea Statului din cauza corespondenţei sale cu marele istoric al religiilor,
Mircea Eliade, care era considerat de regimul comunist
un duşman al poporului datorită preocupărilor lui
cu privire la sistemul yoga şi la misticismul oriental. Casa lui a fost percheziţionată
sub pretext că ar fi ascuns arme. După investigaţii amănunţite, i-au confiscat toate cărţile
de filosofie orientală şi ezoterism, corespondenţa şi caietele cu notiţe. The fact that I came
in contact with Eliade, not knowing at the time that our entire correspondence
was censored, also meant that I was placed on the Securitate’s list of suspects. At some time in 1971, the first search
was done on my house, the reason for which was, of course, completely baffling. They said that they were searching
for certain weapons which were stolen
from a warehouse which to me seemed
like a made-up excuse, because I had never
heard of such a warehouse, I did not even know whether
such a warehouse even existed. But it is certain that
when they left, the three agents from the Securitate who carefully
searched through my house took my entire correspondence and all of my books and notebooks and not the alleged weapons which did not even exist. În 1982, când cursurile de yoga
au fost suspendate, el a continuat să predea pe ascuns. A avut 170 de cursanţi. Pe 17 aprilie 1984, el a fost arestat şi acuzat de complot
împotriva lui Ceauşescu. Securitatea l-a considerat mai periculos decât
un criminal de rând pentru că, în calitate de practicant yoga, se credea că are capacitatea de a acţiona într-un mod subtil
şi paranormal care nu putea fi contracarat
prin mijloace obişnuite. They had some testimonials and one of them said that I had been talking to several people
in a certain context and that I had told them that
we will form a group of yogis who will kill Ceauşescu from a
distance, by paranormal means. In that mix of interests, including this paranoid masquerade that they wanted to save
the life of Comrade Ceauşescu for which they would
receive a promotion, I was considered
an extremely dangerous person, because they believed that I was more dangerous
than a common criminal who may have used a bomb or a gun, because I would have acted in a way which could not be countered. They came up with the idea,
which reached Ceauşescu himself, that Grieg would have plotted
against Ceauşescu and wanted to kill him
by hypnosis, using paranormal means. No matter how strange it may seem, Ceauşescu believed these things. He was surrounded by an army
of parapsychologists and people who were doing
black magic. Both he and Elena Ceauşescu
were very interested in such occult information. It was easy for Ceauşescu
to believe such a thing. Therefore, involvement
in such a matter was considered an attempt at a
“coup d’etat”. Even if, from
a juridical point of view, there was no allusion to hypnosis
or paranormal activities, they still tried to frame him for wanting to create
an organised group, to launch a sort of paranormal attack
on the “beloved” leader. This is what was in store
for him. And they also told Grieg. Knowing that he was not going
to get past these accusations and that many years
in prison were awaiting him, Grieg realised that
the only solution was to escape. This was his last resort and he organised
his escape from prison, which remains unique to this day. No one else has ever escaped
from the Rahova prison. I was there myself and
I saw everything. I even saw Grieg’s cell, I saw where he escaped from and I figured out how
he managed to do so. And after seeing the place,
I know how he escaped. I can say that
it was a paranormal act. After three days, I organised my own escape
from the prison of the secret police, a place from which no one else
had ever escaped, as I was told afterwards. It is true, Yoga techniques
fully helped in this. Eventually, I was only convicted
for escaping from prison and was senteced to 1 year
and 6 months in prison. This was quite strange,
and everyone in prison was amazed that I was in jail
only for escaping and nothing more. In spite of all this, I was kept in chains
for a year and a half because now I was considered
to be very famous because I escaped from a place
no one else had escaped from. În închisoarea Mărgineni,
Bivolaru a fost ţinut în lanţuri deoarece a scăpat
din arestul Securităţii, unde a fost deţinut fără
vreo decizie judecătorească. Mai mult, pe lângă evadarea sa,
Bivolaru nu a fost acuzat de vreo altă infracţiune
în baza legilor acelei perioade. I escaped and thus
I protested against and stopped
an aberrant investigation. After the escape, he was taken
to the Mărgineni prison where he was kept in chains, because protocol
stipulated this for people who had
escaped from prison. They were bound to one place
with chains around their ankles. Even though he was surrounded by dangerous criminals
serving a life sentence and despite having
his legs bound in chains, he continued practising yoga. I also found out that they broke
the window of his cell, which meant his cell was very cold. Yet he continued
to practise a great deal. In winter, they threw water
on the cement floor of his cell because they wanted
to make him fall ill. They even exposed him
to radiation. They went a long way
to try to exterminate him. This is what such
communist prisons did to people who
did not obey the system. They did their best to make men
give in to torture. After collecting many
witness statements, Gabriel Andreescu speaks
about the fact that the Securitate tortured and beat him. Pe lângă acestea, mulţi dintre
cei care urmau la acea vreme cursurile de yoga ale
profesorului Gregorian Bivolaru au fost arestaţi şi bătuţi
de agenţii Securităţii. There was a tremendous tension. One was always being watched
by the Securitate while practising yoga in Romania
before the 1989 Revolution. They had a strategy of beating people in a way so as not to leave
marks on their bodies. So you could not go
to a forensic doctor and show that you had suffered
in the interrogation room. So they beat
you very harshly, but without leaving any marks. For instance, they put me
on my knees on a chair and tied my hands to
the back of the chair and they kept hitting my feet,
through my shoes, with a rubber club. But even this
was very painful. They did this until they were
satisfied with the outcome. But they beat Grieg up
with much more brutality. I can say that the toughest, the most heart-rending and
difficult moments for me were not the times when
I was interrogated, but the ones when I could
hear them beating up Grieg, because the interrogations rooms
were close enough. And they beat him
with beast-like brutality. Realising that, in spite of all
the inhumane treatments that I was subjected to, I would never stop practising yoga, they finally decided
in the same abusive manner that in 1989 I was to be
forcibly committed to the psychiatric hospital
in Poiana Mare. This hospital is currently
well known for being the place were political dissidents
of the Ceauşescu regime were sent to be exterminated. They were labelled as crazy and they were forcibly
committed to the hospital. They were subjected to
very destructive treatment which was actually designed
to destroy them. Nowadays, it is well known
that before 1989 in Romania agents of the Securitate
had grown accustomed to mercilessly and
systematically compromising people who were considered
unwanted by the Communist regime, as a result of various types
of political resistance which they manifested. These people were subjected
to all sorts of set-ups and this is why they were wrongfully
accused of common-law offences or, in some extreme cases, they were forcibly committed
to psychiatric hospitals. This was also my case. It was a way of hiding
the real intention of the regime regarding those who defied
the communist ideology one way or another, and those who did not agree
with the cultural politics of the communist dictatorship. They wanted to create
a “new man”, a type of man who has not been seen
by anyone even to this day, but who had to obey
the communist regime, to listen to the party activists, to respect
the communist administration, including the judiciary bodies,
the police and the Securitate (secret police), and who was, in fact,
swallowed by the system to such an extent that they
would lose their personality. They did not have freedom
of movement, of thought… Taking into account
the fact that I hoped that after 1990,
there would be justice in my case, as would have been natural, I want to state that, during
the hideous dictatorship of the Ceauşescu regime, when they decided to commit me
to a mental hospital because I was “irresponsible”, I requested a psychiatric
counter expertise. In spite of all this,
my request was rejected, both during the first trial
and during the appeal that I requested. When I was
forcibly committed to the hospital of Poiana Mare, I survived
under terrible conditions, and I was often forced to take
strong psychotropic drugs and I was injected with dangerous
psychotropic substances with the sole purpose of destroying
my nervous system and my health. These abusive and criminal
psychiatric treatments were aimed at
slowly annihilating me both psychologically and mentally,
even physically. Being investigated
by the Securitate, he went through various stages of being held in
the secret police’s dungeons, and in 1989
he was sent to Poiana Mare. What I have in here… Poiana Mare is that
psychiatric hospital for which we just have been
“scolded” again. Yes. So he was subjected
to psychiatric abuse. The Securitate ordered the doctors
to pump him with drugs that could destroy a normal person
in a month, at the most. The doctor who was designated
to treat Grieg said that he was not going
to do such a thing. He risked his own job. He replied that even
the most awful criminals are not treated like that. He was diagnosed with
paranoid schizophrenia, if I remember well, but it was not so, I said I could
not accept such a diagnosis. He was not a man who
required psychiatric treatment. Something was forced, though I cannot tell you exactly
who was behind it. He was a self-taught man who had read a tremendous amount and he was well-trained in many fields. Often he would know
a lot more than I did and I had to withdraw

Gregorian Bivolaru a refuzat să facă aceasta. Of his own will, the doctor told Grieg:
“I can’t do this do you because I am a doctor. I cannot possibly kill you
with my own hands. So I fake giving you the drugs,
nay, I give them to you and you pretend taking them. But you should know the drugs
are meant to destroy you.” So this doctor risked his own career for a man he did not know,
simply because he had the verticality. He could not do such an evil thing
to an unknown man even though the man was
presented as a great criminal. I want to point out that, in that psychiatric hospital
in Poiana Mare, the living conditions were awful
from all perspectives, including the lack of food and heating. During that time, I helplessly witnessed many deaths of
the so-called patients, who died because
the hospital was run like an extermination camp,
with great cruelty. Some of these disturbing aspects
are recounted in detail in the work “The Oppression of
the Yoga Movement during the 80’s”. Here you can find the results
of the elaborate research carried out by Mr Gabriel Andreescu within the CNSAS Archives
(Securitate Archives). Decembrie 1989,
Revoluţia Română At the beginning of the
Revolution of December 1989, as it was very well known that
I was locked up abusively, without actually
being mentally ill, I was immediately released
by a committee of psychiatrists, but without denying my diagnosis. Please note that, even if
it is a paradox, I am even currently and abusively put
in two contradictory legal positions which exclude each other. This means that even though the psychiatric diagnosis
I was given in 1989 was never denied, and the doctors I talked to
even told me that this diagnosis will remain
forever unchanged in Romania, in spite of this, in this case I was sent to trial
as a sane person. When I talked to a lawyer
from Sweden about this, he was astonished
and told me that: “Such a thing is impossible
and inadmissible.” I replied that,
unfortunately, Romania is currently the country
where anything is possible, especially bad things. Not even after I was released from the psychiatric hospital, even though they knew very well
that I had been a victim of internment on political command, my request to change the alleged
psychiatric diagnosis from the Communist period
was denied. Therefore,
this pshychiatric diagnosis which states that I am
an irresponsible person, was never denied. În martie 1990, profesorul de yoga Gregorian Bivolaru
a reînceput să predea yoga. Mai întâi s-au deschis
cursuri în Bucureşti, apoi, la scurtă vreme,
în toată ţara. Cursurile erau ţinute
de instructori competenţi, sub îndrumarea directă
a profesorului Bivolaru. Pe lângă cursurile de yoga, s-au dezvoltat şi
alte domenii de studiu. În cadrul Mişcării de Integrare
Spirituală în Absolut, sau MISA, există acum cursuri de şivaism,
I-Ching, alchimie tantrică, astrologie şi medicină naturistă. Aceste cursuri sunt urmate
de peste 35.000 de români şi aproape 7.000 de cursanţi
din Danemarca, Anglia, Germania, Franţa, Olanda, SUA,
Japonia şi Canada. Deşi regimul comunist a fost schimbat
după Revoluţia din decembrie 1989 şi cursurile de yoga
au devenit din nou legale, după doar doi ani, problemele
au început din nou să apară. Mai întâi în ceea ce priveşte
închirierea sălilor de curs, apoi au urmat ameninţările. Iar în august 1994 profesorul Bivolaru a fost bătut în timpul unei tabere internaţionale
de yoga din Costineşti, în camera lui de hotel. “Dacă nu te potoleşti şi
o să continui cu ‘dezvăluirile’, o să ajungi din nou la puşcărie, unde
ţi-e locul, şi o să-ţi facem din nou o bucurie, aşa cum ţi-am mai făcut,
de care suntem siguri că nu ai uitat.” A group of well-built men rushed through the door and began to destroy
pieces of furniture. They threw books and
other material goods from the room
out of the window. They punched Mr. Bivolaru and kicked him. They hit him,
his glasses fell on the ground, he bent down to reach for them,
so they kicked him again. It was a very violent scene. They were shouting, “We warned you!
We will teach you a lesson !” Deşi au existat martori

nicio investigaţie în acest caz. In 1996, as I had once again become a so-called dangerous person
to the political regime, or, to be more precise,
to the Social Democratic Party, even though
it seems unbelievable, there was yet another attempt to forcibly commit me
to a psychiatric hospital. Based on so-called complaints, I was invited twice to stand in front of a committee
of psychiatric doctors at the Institute of Forensic Medicine
in Bucharest. But because I benefitted from the intelligent assistance
of an attorney who advised me not to go to those abusive and
completely illegal invitations, I managed to escape from a new and
unavoidable committment to a psychiatric hospital based on the old diagnosis of
being an irresponsible person. In this way,
I only received a fine. However, a student from the
Medical School who knew me and was practising at
the Institute of Forensic Medicine informed me confidentially that, during the two days, a committee of psychiatrists
had waited for me for hours, and that they were supposed
to “examine” me in order to send me by force
to a psychiatric hospital. In spite of this, even though I continued
to be considered as an irresponsible person, paradoxically,
in 2004 I was arrested and the old diagnosis
of irresponsible person was and remained completely ignored, but not annulled altogether. This serious abuse, this inadmissible illegality
for a democratic state persists even to this day,
and it is inadmissible. Taking these serious aspects
into account, I wonder what you will do
regarding these aspects which indicate a double hypostasis, from a juridical point of view, which was shrewdly
used in turn by both the communist regime
and the current regime, in order to reach their dirty,
inhumane goals, which mock the idea of justice
in this country. Taking these particularly
serious aspects into account, I dare to ask you,
as a person of law, what kind of justice is this which itself gravely
and grossly violates the law, and at the same time expects the citizens of this country to obey the given laws. I wonder what your reaction will be on finding out about
this serious illegality which I was faced with and which was not the only one. 2004,
